Agreements

STANDARD TERMS & CONDITIONS Administration • Identification must be presented and a photo taken at the time of sign up. • All members must swipe their membership card each time they attend the Centre and at any other time as requested by authorised staff. • The facilities are available to the public and not exclusively for members. • Where a membership card is lost or damaged, the member is required to obtain a replacement card free of charge. • It is the members responsibility to advise of any changes to name, address, email address or phone number. • The South West Sports Centre (SWSC) uses email as the primary method of communication. All members require a valid email address to sign up at the SWSC. Conduct/Behaviour • We will refuse entry, or request any person to leave the premises if that person: a) is abusive or uses offensive language, displays threatening behaviour or b) is under the influence of drugs or alcohol c) displays behaviour that may be deemed inappropriate by staff and/or patrons. • No smoking is permitted in or near any entrances to the Centre. • The membership is for the exclusive use of the contracted member and may not be shared or transferred. Minimum Age Requirements • The minimum age to access the Gym is 14 years. • Gym Members and casual users under the age of 16 years are required to attend at least one appointment with a trainer prior to first use of the gym. • Age restrictions apply to classes as designated on the timetable. • A parent/guardian is required to attend in-person, to activate the membership of anyone under the age of 18 years. • Proof of age may be required at the time of sign up and/or when the membership is activated. Gym & Group Fitness • Members must bring a towel to every workout and wipe down the equipment after each use. • Appropriate clothing and enclosed shoes must be worn at all times. • There is no entry allowed into a group fitness class 5 minutes after it commences. • Timetables are subject to change and positions in classes cannot be guaranteed. Aquatics • No creams, oils or soaps are allowed in the pools or spa. • Appropriate swim attire only, no clothing allowed in pools or spa. • Designated areas of the pools are closed to members during swim school lessons and paying user groups. Times vary and pool availability is posted at reception, in Aquatics Hall and on our website Payments • Ezidebit is our third-party direct debit payment provider. •Customers may request their Direct Debit agreement at any time.•Payment charges are as follows:a)A one-off Administration/Set up Fee $2.20 applies to all new direct debit arrangementsb)Missed payment - $14.80 per missed direct debit•The Direct Debit Request (DDR) & Contract is deemed to be an Ongoing Membership Agreement. The agreement will continue until either you or the SWSC cancel it in the way described in the agreement.•SWSC reserves the right to amend membership terms and conditions, membership fees, and membership inclusions as per adopted Schedule of Fees and Charges of the City of Bunbury. Members will be provided with reasonable notice of any changes. Continued use of membership following the effective date of the changes will constitute acceptance of the updated terms and conditions. Cancellation COOLING OFF PERIOD •Members have the right to cancel their membership within the cooling-off period at nocharge. Cooling off period commences at 7pm on the day of on-site sign up or activation andceases at 7pm, 7 days later. •All monies will be refunded with the exception of charges for services already delivered. •Cancellations during this period must be in writing on a SWSC Cancellation Form or viaemail and must be submitted PRIOR to the end of the cooling off period. 14 DAYS NOTICE OF CANCELLATION •All applications for membership cancellation (both direct Debit and upfront agreements)must be presented on SWSC Cancellation Request Form. The cancellation form is available onthe Centre website or at Centre reception. •You will need to provide 14 days notification prior to the required cancellation date,whereby one more payment will be deducted within the 14 days. •Membership Cancellation is not complete until you (the member) receive emailconfirmation from the SWSC. •If you cancel the agreement or stop the automatic debit arrangement in a manner notdescribed in the agreement, you may be liable to the SWSC for any outstanding membershipfees. •Refunds on upfront memberships are calculated on a pro-rata basis. •Management reserves the right to suspend or cancel a membership where the membershipfees are in arrears. •If the Centre is unable to provide services/programs due to unforeseen events(s) this doesnot automatically entitle the member to terminate their membership/obtain a refund. •Memberships cannot be cancelled whilst on suspension. On receipt of a cancellationrequest, the suspension will be lifted and the 2-week notice applied as per our cancellationpolicy. Suspension •A 12-week suspension privilege is available within a 12-month period. •The 12-month period for an ongoing direct debit arrangement will run over a calendar year,whilst 12-month upfront memberships will run over the membership period. •The minimum period allowed for suspension at any one time is 2 weeks. •Request for membership suspension is to be made with member services at least one weekprior to intended absence. •Suspensions will not be backdated unless accompanied by a medical certificate. •Suspensions must be in line with the direct debit payments where applicable. Extra Services •Some Centre services require an additional fee, these include but are not limited to PersonalTraining, Crèche, Swimming Lessons, Squash and Team Sports. Operational Changes •The Centre may as reasonably necessary: a)Close off any part of the premises or isolate any piece of equipment for maintenance orsafety reasons. b)Change the hours of opening and closing c)Vary Centre rules •Where this occurs, the Centre will endeavour to provide reasonable notice via membercommunication, Centre noticeboards or at reception. Breach of Terms and Conditions •A breach of these conditions will result in a warning; any further breach may result in yourmembership being suspended or terminated. Member Communication •Members may be contacted by the South West Sports Centre team for follow-up ormarketing purposes. •South West Sports Centre will store your information securely, and in line with the Privacyand Responsible Information Sharing Act 2024 (PRIS Act)
